Can you file a civil suit after winning an ICANN decision?
There is a direct competitor in another country who has registered a domain that is very similar to the domain name of my company in a very clear case of “typosquatting”. After reviewing ICANN rules and regulations it is obvious that the other individual is guilty and if I file a complaint the domain name will be transferred to me.
Jurisdiction issues aside, will I have the right to sue the offending individual for legal fees (associated with the original arbitration proceedings), and other damages?
I ask because I will attempt a cease and desist letter before filing to try and save my time and money, and I want all the ammunition I can have to make this individual see reason.
The offender resides in the UK.
You have to look to see if the other country has laws set aside for such a case. Just because they are enforced here means zero to some countries and as such the other party can be protected from such suits.
